Subscriber Terms & Conditions (v1.0)
By registering for this service, you agree to these Terms and Conditions. This service allows you to purchase a 30GB monthly Telkom “Anytime Data” subscription at R285.00 per month through a commercial agreement with SUCCESSCO 125 (PTY) LTD (“SuccessCo”).
1. The Service
1.1 This is a month-to-month mobile data subscription linked to a Telkom SIM card supplied by SuccessCo and applies to new SIM activations only.
1.2 The subscription includes 30GB Anytime Data per month, with 30-day rollover of unused data.
1.3 Data is automatically allocated by Telkom on the 1st day of each month and will repeat monthly unless cancelled.
1.4 From the second month onwards, you will also receive 30GB Night Data (11PM–7AM) valid for 30 days.
2. Pricing and Activation
2.1 A once-off SIM activation fee of R99.00 applies per SIM card.
2.2 The first payment is R384.00 (R285 subscription + R99 activation).
2.3 Thereafter, the monthly subscription fee is R285.00 per month, payable unless cancelled.
2.4 SIM cards are only available via Sponsors, who will assist you with registration and activation.
2.5 The subscriber agrees to create a recurring/scheduled payment in his banking app so that the subscription is paid on time each month
3. Data Allocation Rules
3.1 If your SIM is activated on or before the 15th of the month, you will receive 30GB immediately, and a further 30GB on the 1st of each following month.
3.2 Note that if you pay in the first half of the month for the current month, another payment will be due by the 20th for the next month.
3.3 If your SIM is activated on or after the 16th of the month, you will receive 5GB free data to use in the remainder of the month.
3.4 In this case, your R285 subscription payment will be applied to the following month’s data allocation.
4. Payments, Billing, and Suspension
4.1 Subscriptions are billed monthly in advance on the 15th and are payable by the 20th for the following month.
4.2 You are responsible for ensuring payment is made by EFT using the account number and reference issued by SuccessCo.
4.3 Data for the new month is allocated on the 1st of each month.
4.4 If your account is overdue, your SIM card may be suspended.
4.5 If your line is suspended due to late payment, reconnection may take up to 48 hours after payment reflects.
4.6 If payment for the new month is not received at least five days before month-end, your SIM may be queued for cancellation and the mobile number may be lost permanently.
5. Subscription Term and Cancellation
5.1 This is a month-to-month subscription with no long-term contract.
5.2 You remain liable for monthly fees until the SIM is cancelled by you or by us.
5.3 You may cancel at any time via your SuccessCo dashboard. Upon cancellation, the SIM will be terminated, and any remaining data will be forfeited.
5.4 Once cancelled, the SIM card and mobile number are permanently terminated and cannot be reused.
6. Top-Ups and Additional Data
6.1 Additional airtime top-ups are available at standard ICASA-approved retail rates and are for your own account.
6.2 Airtime can be purchased at stores, banks, ATMs, or online suppliers.
6.3 Additional 5GB Anytime Data bundles may be purchased via the website at R39.00 per 5GB, subject to availability.
6.4 This access to 5GB data is reserved for subscribers who have a credit balance on their wallet at time of ordering (a positive, prepaid balance)
7. SIM Card Responsibility
7.1 You are the contracting party and remain responsible for the SIM card issued to you.
7.2 Lost or stolen SIM cards must be immediately suspended via the dashboard.
7.3 A SIM swap is required for lost or damaged SIM cards and costs R99.00. SIM swaps can only be performed via the dashboard.
8. RICA, Records, and Reporting
8.1 SIM cards are RICA-registered in the name of FREEPAID and assigned to you for personal or business use.
8.2 Your name, email address, and current cell number will be linked to the SIM and used for RICA compliance and usage reporting only.
8.3 This information is treated as confidential.
9. Privacy and Confidentiality
9.1 SuccessCo is POPIA compliant.
9.2 Personal information will not be shared with third parties unless required by law.
9.3 All information you provide is treated with strict confidentiality.
10. Network Agreements
10.1 SuccessCo has fixed-term agreements with the mobile network, but you are not bound to any long-term contract.
10.2 Because your subscription is month-to-month, you may cancel at any time, subject to these Terms.
11. Refunds
11.1 Once data has been allocated to a SIM card, it cannot be returned or refunded, whether used or not.
11.2 No refunds are offered for data already delivered.
12. General
12.1 Your data balance can be viewed at www.simbalance.co.za or on your SuccessCo dashboard.
12.2 All prices include VAT.
12.3 You confirm that you are 18 years or older and legally authorised to enter into this agreement.
12.4 By registering and making payment, you confirm acceptance of these Terms and Conditions.
13. Service Availability and Network Performance
13.1 SuccessCo provides the subscription service on a best-effort basis using third-party mobile network infrastructure.
13.2 SuccessCo does not guarantee network coverage, speed, latency, uptime, or quality of service.
13.3 You acknowledge that the service may be interrupted, limited, or unavailable from time to time due to network faults, maintenance, congestion, power outages, or factors beyond SuccessCo’s control.
13.4 No refunds or credits will be granted for network-related interruptions, reduced speeds, or service unavailability.
14. Fair Use and Acceptable Use
14.1 The service is intended for normal personal or business internet usage.
14.2 You may not use the SIM card or service for any unlawful purpose, including but not limited to fraud, spamming, hacking, harassment, or any activity that violates South African law.
14.3 You may not resell, redistribute, or commercially exploit the service unless expressly authorised in writing by SuccessCo (Allowed for in the Affiliate program).
14.4 SuccessCo reserves the right to suspend or terminate the service without notice if misuse, abuse, or unlawful activity is suspected or detected.
15. Limitation of Liability
15.1 To the maximum extent permitted by law, SuccessCo shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to loss of data, loss of profits, loss of business, or service interruptions, arising from the use of or inability to use the service.
15.2 SuccessCo shall not be liable for any acts or omissions of the mobile network operator or any third-party service providers.
15.3 If SuccessCo is found to be liable for any reason, its maximum liability shall be limited to the total subscription fees paid by you in the preceding one (1) month.
16. Indemnity
16.1 You agree to indemnify and hold harmless SuccessCo, its directors, employees, and agents against any claims, damages, losses, or expenses arising from:
a) Your use or misuse of the service or SIM card;
b) Any unlawful or prohibited activity conducted using the SIM card;
c) Any breach of these Terms and Conditions by you.
17. Right to Amend Terms and Pricing
17.1 SuccessCo reserves the right to amend these Terms and Conditions, pricing, bundles, or service offerings from time to time in line with the market or changes at the Mobile Network.
17.2 Any such changes will be communicated in advance via the website, dashboard, email and/or other reasonable means.
17.3 Continued use of the service after such changes constitutes acceptance of the updated terms.
18. Suspension and Termination by SuccessCo
18.1 SuccessCo reserves the right to suspend or terminate your SIM card or subscription without notice if:
a) You breach these Terms and Conditions;
b) You fail to make payment when due;
c) The service is used for unlawful, fraudulent, or abusive purposes;
d) Required by law or by the network operator.
18.2 In such cases, any remaining data and subscription fees are forfeited, and no refunds will be due.
19. Force Majeure
19.1 SuccessCo shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to network failures, power outages, strikes, riots, natural disasters, acts of government, or acts of God.
20. Governing Law and Jurisdiction
20.1 These Terms and Conditions shall be governed by the laws of the Republic of South Africa.
20.2 You agree that any disputes arising from or relating to this agreement shall be subject to the exclusive jurisdiction of the courts of South Africa.
21. Severability
21.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
22. Entire Agreement
22.1 These Terms and Conditions constitute the entire agreement between you and SuccessCo regarding the service and supersede any prior agreements or representations, whether written or oral.
